US District Court Judge McShane reviewed our Preliminary Injunction after oral arguments by attorneys for NRCS, AID and Save Arnold Canal. He decided that the work on the pipe could continue even though there would probably be “irreparable harm” to canal properties. In his opinion, the “scales do not tip in” SAC’s favor enough to warrant stopping construction immediately.
This is not a “Summary Judgement” so issues raised by the SAC Complaint are still before the court and could proceed. In light of this development, SAC is reviewing possible paths forward with an eye towards available funds and the likelihood of success.
